The websites, mobile websites, mobile applications, and technology platforms (the “Sites”) and other online services, including but not limited to rewards programs and subscriptions or memberships (the “Services”) are owned, operated, and provided by or on behalf of Kj’s Market (the “Company”). This Privacy Policy (the “Policy”) provides you with the details on how the Company treats the information provided by you when you are using or accessing the Sites or Services. By accessing and/or using the Site or Services, you hereby accept and agree to all the terms and conditions in this Privacy Policy and consent to the practices herein.

Information Collected. The Company collects a range of information from you when you use the Sites or Services or visit our retail grocery locations (“Stores”). We collect the User Information below directly from you and your interactions with the Sites and Services, which may include keeping a record of your transactions while using the Sites or Services. To use all the functionality of the Sites, Services, or in-store shopping benefits, you may be asked to provide personal information. Information, which includes some personal information, about you that is collected by the Company includes, but is not limited to the following (hereinafter referred to as “User Information”):

• Name, postal address, email address, and phone number;
• Payment or financial information;
• Communication records regarding interactions with our Guest Services teams;
• Transaction information, including, without limitation, purchasing records, preferences, merchandise choices or shopping characteristics and history;

Use of User Information. The Company maintains, discloses, uses, and shares User Information as provided below. The Company does not control the privacy policies or practices of third parties and is not responsible for the information they may collect or the content of their sites. • Provide, operate, process, or complete the Sites or Services;
• Legitimate business purposes and to enhance or develop business operations;
• Identify or verify proper access to the data and functions within the Sites;

• For the purpose for which you are providing the information;

• Manage participation in the Fresh Rewards loyalty program;
• To enable third party marketing providers to conduct offline and online campaign measurements, analytics, and development of insights; create modeled online and offline audiences for products and services; allow the Company to deliver marketing materials to physical addresses based previous purchase behavior; to enable the Company to personalize products and Services, including site optimization, email personalization and dynamic marketing, and advertising optimization;
• Research, market analysis, or product enhancement;
• As required by law, regulation, court order, or other regulatory requirements;
• Protect the rights or property of the Company, its employees, Guests, or other individuals, entities, partners, affiliates, providers, or licensors;

• Create Guest profiles reflecting purchase history, shopping behavior, and household demographics;
• In connection with actual or suspected illegal activities and investigations thereof.

Opt-Out. You may choose not to provide information when requested; however, in the event you choose not to provide the requested information, you may not be able to utilize certain features, functionality, or offerings available from the Sites, Services, or in-Store. By subscribing to SMS/text messaging, you agree to receive marketing and/or promotional text messaging that includes messages about offers and updates from the Company at the mobile number submitted when opting in (for more information please visit the Terms and Conditions).You have the following options regarding your User Information:

• Opt-out of receiving marketing and advertising promotions or the sharing of your User Information,
• Correct and update your User Information, or
• Cancel your account.

To opt out of receiving marketing and advertising promotions via email, please follow the “Unsubscribe” link in the email communication provided from the Company. To opt out of direct mail marketing, the sharing of your User Information with third parties, or to request a copy of or deletion/erasure of your User Information please email wecare@kjsmarket.com. To opt out of SMS/text messaging reply “STOP” in response to an SMS/text message received from the Company at any time. For help regarding SMS/text messaging, text “HELP” in response to an SMS/text message received from the Company or email wecare@kjsmarket.com. Message and data rates may apply to SMS/text messaging, and frequency may vary. To correct or update your User Information, please login to your account to edit your profile.

Retention. Subject to limits imposed by applicable law, the Company reserves the right to retain your User Information for any reasonable business purpose or as reasonably useful or needed until such time that the Company, in its sole discretion, decides to remove such data, even in the event you elect to cancel your account or opt out of marketing communications. The Company reserves the right to remove User Information at any time from its records as appropriate in the sole discretion of the Company.

Security. The Company maintains physical, electronic, and procedural safeguards designed to protect your nonpublic information. Our comprehensive security measures include advanced virus protection, state-of-the-art firewalls, and activity logs. While the Company employs rigorous security measures to protect your User Information, we cannot guarantee that computer hackers, security failures, or other attacks will not compromise your User Information.

Transferability. In the event the Company goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your User Information may be among the assets transferred. You will be notified by means of a notification posted on this Site for at least thirty (30) days of any such change in the ownership or control of your User Information.

Child Privacy Protection. The Company does not knowingly collect information about children under the age of thirteen (13) years old. Governing Law. The Company’s Sites and Services are provided solely to those persons, users, and customers in the United States of America (the “U.S.”) and are not geared towards individuals located outside of the U.S. As such, this Policy is governed by and construed in accordance with the laws of the State of North Carolina, which may have different data protection rules than other jurisdictions.
